Welcome to the Informational Website for the Mercury Payment Systems Settlement

A settlement has been proposed to end a class action lawsuit brought by merchants against Mercury Payment Systems, LLC (now known as Vantiv Integrated Payments, LLC) (“Mercury”) and Global Payments Direct, Inc. (“Global”) (collectively “Defendants”). The lawsuit, referred to as Champs Sports Bar & Grill Co., et al. v. Mercury Payment Systems, LLC and Global Payments Direct, Inc., Case No. 1:16-CV-00012-MHC (N.D. Ga.), contends Defendants overcharged for processing payment card transactions by marking up items on merchants’ monthly invoices that were to be passed through at cost and adding unauthorized fees. Defendants deny they overcharged merchants.

Current Customers have the option to receive a cash payment or a credit of twice that amount to be applied towards the purchase of specified products and services sold by Mercury. Those products and services are:

  • StoreCard
  • OmniShield Assure
  • Fast Access Funding
  • Vantiv BizShield
  • Vantiv Insights
  •  

If you are a Current Customer, you will automatically receive a cash payment via electronic funds transfer unless you affirmatively decide to take the Credit Option. You can see details about the available products and services and choose that option in here. The estimated amount of your cash payment is shown on the email or postcard sent to you about the Settlement. If you want to choose the Credit Option, you must do so by October 13, 2017.

Former Customers who file a valid and timely claim are eligible to receive a cash payment. If you are a Former Customer, the amount of the payment you are eligible to receive is shown on the postcard or email sent to you about the Settlement. The deadline for filing your claim is October 13, 2017.

Your legal rights are affected whether you act or don’t act. Read this website carefully.

YOUR LEGAL RIGHTS AND OPTIONS IN THIS SETTLEMENT:
DO NOTHING

If you are a Current Customer, you will automatically receive a cash payment and forfeit your right to sue Defendants for the claims being resolved by this Settlement.

If you are a Former Customer, you will receive no compensation and forfeit your right to sue Defendants for the claims being resolved by this Settlement.

ACCEPT THE BENEFITS OF THE SETTLEMENT

If you are a Current Customer, you may choose to accept, instead of a cash payment, a credit of twice the cash payment to be applied to the following specified products and services offered by Mercury: StoreCard, OmniShield Assure, Fast Access Funding, Vantiv BizShield, and Vantiv Insights. To choose the credit, you must follow the instructions here.

If you are a Former Customer, you must file a Claim Form to be eligible for a cash payment. This is the only way to receive compensation from the Settlement if you are a Former Customer. You may complete the Claim Form here.

OPT OUT OF THE SETTLEMENT

If you ask to be excluded, you will not receive any benefits from the Settlement, but you may be able to file your own lawsuit against Defendants for the same claims.

OBJECT You may remain in the case and file an objection telling the Court why you do not like the Settlement. If your objections are overruled, you will be bound by the Settlement.
